Legal Policy Action UpdateThe Federal Trade Commission filed a proposed order in the U.S. District Court for the District of Idaho that would bar Kochava and Collective Data Solutions (CDS) from selling, licensing, transferring, or disclosing precise location data without affirmative express consent unless the data is used to provide a service consumers directly requested. The order also requires a sensitive location data program, supplier consent verification, consumer access and consent-withdrawal controls, incident reporting for third-party misuse, and a data retention and deletion schedule, following allegations that Kochava sold geolocation data from hundreds of millions of mobile devices through an AWS Marketplace feed that could reveal visits to mental health and addiction recovery facilities, reproductive health clinics, places of worship, and shelters.
