Texas obtained a temporary restraining order against Samsung, immediately blocking ACR collection of audio and visual viewing data from Texas consumers on smart TVs. The court said Samsung must stop using, selling, collecting, transferring, and sharing the data until January 19. The order matters because it constrains a consumer-device telemetry system that captures periodic screenshots and analyzes viewing activity. A hearing is scheduled for tomorrow on whether a temporary injunction will replace the TRO.

Texas court blocks Samsung smart-TV ACR data collection

    Legal Policy Action Update

The State of Texas obtained a temporary restraining order against Samsung Electronics America Inc. and Samsung Electronics Co., Ltd. that bars collection, use, sale, transfer, or sharing of Automated Content Recognition (ACR)-derived audio and visual viewing data from Texas consumers on Samsung smart TVs until January 19. The order cites deceptive ACR enrollment practices, dark-pattern consent flows, difficult opt-out mechanics, and concerns that the data may be accessible to the Chinese Communist Party.
